Steven Milne Worth point out that case was not “Rustige v Angiolini” but “Crown v Rustige”. Angiolini made initial complaint to police, who decided there was a case to investigate and then prosecutors decide to take Rustige to court as there was prima facie evidence that he had committed a crime. Sheriff then heard evidence from both prosecution and defence then concluded Rustige was guilty. Legal system is not perfect but fact that police, prosecutors and court are 3 separate entities reduces the chances of wrongful convictions.
