A man has been found guilty of subjecting former Lord Advocate Dame Elish Angiolini to a campaign of harassment.
Timothy Rustige was convicted of causing fear and alarm to the former prosecutor, who was sent defamatory emails calling her a “satanic woman”.
Dame Elish said she feared for her family’s safety after conspiracy theorists sent threatening emails and wrote blog posts claiming she was responsible for the cover-up of a paedophile ring in Aberdeen.
Police Scotland computer analysts linked Rustige’s desktop computer to a number of Hotmail accounts which sent the emails.
Rustige, 65, denied writing them, claiming they were the work of his wife, his son – also called Timothy Rustige – and an activist group called Prisoners of Conscience.
He said the organisation’s headquarters for the north of England was based at his flat in Altrincham, Cheshire, and members used a communal desktop computer.
Asked what the organisation did, Rustige replied: “We did work with the Palestinians, we worked with Edward Snowden, Bradley Manning, Julian Assange.”
But he told Aberdeen Sheriff Court he was too busy campaigning to stop hacker Gary McKinnon being extradited to the US to be involved in the smear campaign against Dame Elish.
The group also ran a blog called ‘Rusty’s Skewed News View’ which purported to expose members of a paedophile ring in Aberdeen and claimed the former Lord Advocate had covered up its existence.
Dame Elish was regional procurator fiscal for Grampian, Highlands and Islands before becoming the first woman to head the Crown Office, ultimately responsible for all prosecutions in Scotland.
Fiscal depute Christopher Macintosh said: “The truth is it’s a misnomer that you are part of Prisoners of Conscience as you have not shown to have a conscience.
“You have pointed the finger at your won, your wife – anyone to get yourself out of trouble. If this wasn’t so serious it would be laughable.
“This is not the protection of your free speech.”This is the protection of an individual from horrible defamatory comments.”
Sheriff Derek Pyle took just minutes to find Rustige guilty of the charge. He deferred sentence for reports and said he was keeping all options open, including a jail sentence. Rustige was released on bail.
