The authority would like to / has responded by post to this request.

Dear Aberdeen City Council,

what records do you hold on the former beechwood school?

With regards to any criminal offenses that have been recorded and or
investigations that have taken place with regards to allegations made
against staff that operate within this school. Also i would like a
detailed report of incidents.

I regard this was a public school so therefor i feel it should be open to view by any member of the public.

Thank you for your information request of 27 December 2013.  Aberdeen City

Council (ACC) has completed the necessary search for the information

requested

What records do you hold on the former Beechwood School with regards to:

Any criminal offenses that have been recorded and or investigations that

have taken place

ACC is unable to provide you with information on records held on the

former Beechwood School with regards to any criminal offences that have

been recorded and or investigations that have taken place as the cost of

providing it has been calculated as being in excess of the statutory

maximum (£600).

To explain this, Staff records pertaining to Beechwood School are held in

paper format in an off-site storage facility, or if staff have gone on to

work elsewhere and still work for Aberdeen City Council will be held as an

active file by Human Resources . Teachers’ personal files are retained for

life, however the files for other groups of staff who worked at the school

would be retained for a shorter period of time, with destruction of a

staff file occurring generally seven years after they have left the

service of the Council.  A centralised database for complaints has

operated since April 2012, however as Beechwood School closed in 2010,

there is no centralised record held of complaints made prior to 2012.  To

provide this information, an ACC Officer would need to search through all

staff records held in the off-site storage facility, and indeed in any

active employee files for staff in schools.  HR have advised that they

currently have 397 boxes in the off-site storage facility, with an average

of 10 staff files in each box.  As well as the archived files we have

approximately 4,000 ‘active’ staff files for Education, Culture and Sport

personnel.   To search these files has been calculated at 5 minutes per

file, which equates to 664 hours, at the cost of £9,960 in total.

In order to comply with its obligations under the terms of Section 16 of

the FOISA, ACC hereby give notice that we are refusing your request under

the terms of Section 12 – Excessive Cost of Compliance – of the FOISA.

ACC would be happy to discuss ways in which you may refine your request,

so we can provide some information of interest to you within the maximum

cost limits.  Please do contact the Access to Information Compliance team,

who will be happy to advise you, if this is something you would like to

pursue.

Allegations made against staff that operate within this school.

ACC is unable to provide you with information on records held on the

former Beechwood School with regards to allegations made against staff

that operate within this school as the cost of providing it has been

calculated as being in excess of the statutory maximum (£600).  To explain

this, the same exercise as for the question above would need to be carried

out to provide this information.  In order to comply with its obligations

under the terms of Section 16 of the FOISA, ACC hereby give notice that we

are refusing your request under the terms of Section 12 – Excessive Cost

of Compliance – of the FOISA.

Also I would like a detailed report of incidents.

ACC is unable to provide you with information on a detailed report of any

incidents as the cost of providing it has been calculated as being in

excess of the statutory maximum (£600).  To explain this, the same

exercise as for the question above would need to be carried out to provide

this information.  In order to comply with its obligations under the terms

of Section 16 of the FOISA, ACC hereby give notice that we are refusing

your request under the terms of Section 12 – Excessive Cost of Compliance

– of the FOISA.

We would like to take this opportunity to advise you that procedures are

in place to deal with complaints of a serious nature made about schools or

school staff, such as matters concerning teacher conduct, competency and

allegations made against staff.  Complaints are investigated, and

depending on the findings of that investigation, disciplinary action may

be taken against an employee in accordance with ACC’s Managing Discipline

Policy (attached).
